How to Allocate 7 Days Maternity Leave to the Father of the Child?


If you are pregnant right now and is currently employed, you might be aware already that you can allocate 7 days of your 105 maternity leave. As posted on the previous blog about Rights as Employed Pregnant Woman in the Philippines, the Republic Act No. 11210 which is also known and cited as 105- Day Expanded Maternity Leave Law allows the covered pregnant employee to allocate second days of her maternity leave to the father of the child. 

Have you been curious as well on how you can allocate it? Don't worry, you are not alone. I thought this would help you out as well because I have been wondering too and just recently had completed this process. Read further.

As a requirement, this process should includes a notification to SSS and another written letter to inform the father's company. 

First step: Maternity Notification

So, by the time that you had notified your employer that you are pregnant, your employer will ask you to submit the following documents:
  • SSS ID 
  • Another valid ID with photo and birthday
  • Ultrasound report
Together with that, you must also inform your employer if you want to allocate the 7 days leave to the father of the child. You might be asked to fill this form or your employer will do that for you. The form can be downloaded here. This will be submitted to SSS online by the employer.

As a tip, it would be best to allocate the leaves if your husband's salary is bigger than your salary. If not, you may keep the leave instead but it would still depend on your preference because of course it is best to have your husband with you during the first few weeks after giving birth. Note that this 7 day leave includes weekends so that means this is a one week worth of leave.

Second step: Inform Husband's Company About the Allocation

Once SSS is informed together with the maternity notification, you must request your company to send a letter informing the husband's company about the allocation. To do so, you can follow the letter below and advise your company HR with the details so they can come up with the letter and email it to the husband's HR mailbox as well.



That's it. Once that has been sent, the process is complete and you can expect to be on leave for 98 days while the remaining 7 days will be used by your husband.
